As childish as it sounds, maybe the FIA are punishing Mclaren because of Whitmarsh. Being head of FOTA and all. (he is right?)

But...dont get me wrong, this is a seriously asked question; If Red Bull isn't allowed to drive with their flexing wing, why on earth would Ferrari develop such a thing?
(I know, I know, you're not the spokesman for Ferrari (thank god ) but you usually know this kind of stuff)

Red Bull did that with both their wing and flexible floors.
The FIA is a totally reactive body. They never make proactive rules. So you can get ahead of them at times.
That is what Ferrari is attempting.
