2011 Spyder I need help

I still think its a grey area for you. The car wasnt BRAND NEW - bottom line. Sorta like not getting the instruction manual for the Spyder top --- that came with the new car purchase but easily could have been misplaced and not given to the next owner - even after a few miles/months of use.

Just being realistic here. Not bashing you. Of course i want you to get what you want and be happy but if you want every answer on here to be "yes" then i think you are mistaken. I wouldnt make a huge deal out of it.

Another thought --- does your car have a radio & climate control & cupholders?

- That's not even close to the "bottom line." According to information given - the lightweight battery was listed as part of the equipment by the selling dealer and the buyer had every reasonable expectation to expect it's inclusion.

- Is the instruction manual a $1700 optional item that the dealer had in the sales listing for this vehicle? If not I guess I'm not quite seeing the leap as to how that's similar at all!

Anyways, if the car was listed for sale with the lightweight battery option and you bought it assuming it to have all the options listed for sale than you need to be compensated.

My guess is your and the dealer's price negotiations were based off of the MSRP of the car and that MSRP on the battery was $1700 which affected the price you ended up paying for the car. I'm inclined to think that the dealer owes you $1700 minus a percentage equal to the percentage discount from MSRP that you received. That appears to be the most "fair" and "equitable" cash solution unless you specifically want the battery in which case you should be given that instead...

You should immediately get yourself a screen capture of the dealer listing of the vehicle for sale showing the Lightweight battery included.

Did you sign any "We Owe" documents?

Thanks for the support. I am not here looking for yes answers just reasonable ones. I have all emails and text messages from the dealer including one with the attached build list that shows the lithiumion battery option and the price included in the build. You are correct about my offer to buy, it was predicated on the listed items, in fact I had to talk them down from 80K asking price. Yes it does have radio and climate control and all the keys and manuals, except the battery. In fact I got them to throw in a battery tender but was tryin to explain to them the one they were going to give me did not work on a lithiumion battery, so they new that I knew it came with the car. I agree with your thinking if it was listed it was and expectation by the buyer it would be there. I still have not heard from anyone at PNA since my original letter. Will give them a call today and let you all know how it goes.
