I believe it is the action that is involved. So if the BG was de-escalating the situation by retreating then yes, that would be a no-no. However, if the BGs had their back turned in response to either fawk up some other person or commit a bigger "oops" then no. Regardless, it's a pretty slipper slope esp in NY. One of the few places where the thugs have more rights than the sheeple.

From the way the article is written the two that got spinal tapped were otherwise distracted when he pulled out the shotgun and opened up and not in the process of fleeing. Good that he stood his ground.
