The downside for Ferrari is $100,000 in statutory damages, they have to give up the domain name (which is pretty valuable) and disgorge any profits derived from the name.
But what profits are there? Ford would have to show that sponsors signed up only because they believed that the Ferrari F150 was somehow endorsed by or associated with a Ford truck.
I don't see that at all.
But the legal fees are another kettle of fish. They could run 7 figures just to get through motion practice.
