Without you yourself bankrolling the entire process, it aint going to happen legally. And you could end up having your car impounded by dudes in black with very big guns, Skyline style.
The reason why gray market say, 360, E39 M5, etc were legal is because there were US certified same model for sale in the U.S.
This whole thing sucks. If the FMVSS cert didn't cost so much money (read, not 10 or 20 grand), we'll get all kinds of cool cars in the U.S.

There was nothing to pass the R34 off as because it was an entirely unique vehicle with no U.S. sibling whatsoever.

Well the A6 Avant is DOT certified, and I presume the loophole he found has to do with him claiming it's an A6. To be honest I'm unfamiliar with RS VINs, though it could be different than BMW's M Division VIN designation for example and might be identified as an "A6 RS" or something along those lines.
They WILL find you, and if they found that you falsified papers, you are looking at federal prison time.
No car is worth being Bubba's girlfriend in a federal pen.
