  • Motorist researches law, finds out the ticket is bogus
  • Motorist files class action lawsuit against FHP
  • Seeking $100 refund and $15,000 in damages
  • Since 2005, 10,429 drivers have been cited under the statute, so if he won that would be $1,042,900 in ticket refunds, and $156,435,000 in damages.

Hi,

What is the ticket? They are trying to make a law in my state that calls it obstruction of justice (or words to that effect). I think it's complete CRAP. If they are wanting people to slow down for the radar, and flashing them SLOWS THEM DOWN - haven't we achieved the goal?

Oohhh, right. You didn't get the revenue. Here I was thinking they just wanted people to slow down.

The highway patrol has been citing 316.2397, which prohibits private possession of emergency services lights. It does not prohibit a person from using his headlights to signal other drivers.
